Festival Terms and Conditions

Please read these Vista Farms Lavender Festival Ticket Terms ("Terms" or "Agreement") carefully. These Terms apply to the Vista Farms Lavender Festival described on this website (the "Event"). “Attendee” refers to any individual that participates in the Event. The Event producer reserves the right, at its discretion, to change, modify, add, or remove portions of these Terms at any time. Please check back periodically for any changes.

TICKETS & CANCELLATION

Festival Tickets are valid for the date of purchase described on the ticket. Tickets purchased in advance are non-refundable or transferable.

The Event producer is not liable for delays, cancellations, or disruptions due to acts of God, severe weather, or other events beyond its control. If the event organizer cancels the Festival prior to the Event, tickets will be refunded in the method of purchase.

Tickets are required for individuals ages 13 and older. Festival admission is free for children under 12. Minors must be accompanied by an adult for festival admission. Vista Farms is not liable for lost, stolen, or fraudulent tickets.

Ticket confirmation will be emailed to you after purchase and this email will serve as your ticket. You may show this email or print the email to gain admission on the date of the festival.

Each ticket purchased comes with a complimentary bundle of lavender that you may pick in the fields on the date of admission. You will receive a physical ticket for the lavender bundle, a pair of scissors, tie and directions on how to cut lavender. The lavender bundle offer is only valid for your date of admission. If you cannot pick lavender, please contact Festival staff and they will assist you.

SAFETY & LIABILITY

Under Idaho law, there are risks associated with agritourism, which could lead to injury or death. You acknowledge and assume these risks by visiting Vista Farms, LLC. Section 6-3004, Idaho Code.

If the Attendee does not comply with any laws, mandates, health orders or directives, promoter or Event and venue terms, conditions or rules, then the Event producer/promoter or venue operator may refuse admission or require the Attendee to leave the Event and the Attendee will not be entitled to a refund.

By participating in the event, I agree to hold Vista Farms harmless from any and all claims, loss or damage to my personal property, liabilities and costs, including attorney’s fees, as a result of my participation. If Vista Farms incurs any of these types of expenses, I agree to reimburse Vista Farms. If I need medical treatment as a result of my participation, I agree to be financially responsible for any costs incurred as a result of such treatment.

To the fullest extent permitted by Idaho law, Attendee agrees to indemnify, defend, and hold harmless Vista Farms, LLC, its owners, officers, employees, volunteers, sponsors, and affiliates (collectively, the “Festival Parties”) from any and all claims, demands, actions, damages, losses, liabilities, costs, or expenses, including reasonable attorneys’ fees, arising from or related to: (a) Attendee’s participation in the Vista Farms Lavender Festival, including but not limited to personal injury, property damage, or death; (b) Attendee’s violation of any federal, state, or local laws, including Idaho Code Section 6-3004 regarding agritourism risks, or festival rules; (c) Attendee’s negligence, willful misconduct, or breach of these Terms; or (d) any act or omission by Attendee or their guests during the festival in Kuna, Idaho. This indemnification obligation survives the festival’s conclusion and any termination of these Terms.

ADDITIONAL TERMS

Service animals are welcome to enter the festival but please leave pets at home. We reserve the right to deny entry or remove festival participants at any time for any reason.

Attendees may not bring any of the following items into the Event (or cause any of items to enter the Event): glass bottles, aluminum bottles, knives, explosives, sling shots, weapons of any other kind, Frisbees, flags, skateboards, roller skates, hover boards, laser pointers, drones of any kind, remote controlled devices or remote controlled toys, large backpacks, and other items as designated by Event producer. Event producer reserves the right to refuse admission to or remove any person, at Event producer's sole discretion, whose conduct is disorderly, disruptive, or who fails to follow the Event's rules or directions, or whose language is vulgar or abusive.

Attendees grants the Event producer (and its designees) the right to include Attendee's image, likeness, actions, and statements in any live or recorded audio, video, film, webcast, stream, or other transmission, exhibition, simulcast, or reproduction made of, or at, the Event in any medium or context for any purpose, including commercial or promotional purposes, without further authorization or otherwise. Attendees may contact vistafarmsidaho@gmail.com prior to the Event to request exclusion from promotional media, subject to Event producer approval

These Terms are governed by Idaho law. Any disputes arising from the Event shall be resolved in the courts of Ada County, Idaho.
